Do I need a tree permit in Memphis?

The Memphis and Shelby County development code exempts some occupied residential lots from its tree-removal process. That exemption is not permission to cut a public tree. Confirm the property and tree location first. [1035]

We would rather check the boundary than make an irreversible cut.

The occupied residential lot exemption

UDC section 6.1.2A exempts tree removal on a residential parcel containing an existing dwelling, used for that purpose, of ten acres or less. The exemption covers that chapter's notice of intent, tree survey and tree permit. It does not establish that every tree beside a Memphis home is privately controlled. [1035]

Clearing or development is a different question

Outside the listed exemptions, section 6.1.2B sets out notice, survey and approval procedures. The code distinguishes a permit, an approved alternative planting plan and a written waiver. Ask Planning and Development which route applies before clearing a lot. A contractor's verbal assurance is not a written waiver. [1035]

Street trees need a separate check

The UDC also addresses replacement when a required street tree inside the right-of-way is destroyed or substantially damaged. Do not use the residential exemption as a street-tree approval. [1035] Memphis publishes separate public-tree rules in Chapter 12-70 of its municipal code. We could not verify that chapter's current permit provisions during this update. Ask the city to confirm the rule for your location before work.

Utility work and cleanup are separate

MLGW says not to attempt tree work when power lines are near. Call the utility about line conflicts before arranging private work. [1006] For ordinary residential debris, check the city's address-based collection schedule. Do not assume municipal pickup is included in a tree-work proposal. [1022]

What to send for a rule check

Gather the address, a parcel sketch and the tree's position relative to the sidewalk and street. State whether work is routine care or part of clearing, construction or redevelopment. Ask who will secure any approval and keep a copy with the scope of work.

Questions about this work

Does this cover Germantown or Collierville?

No. The UDC applies to Memphis and unincorporated Shelby County, not the county's other incorporated municipalities. Confirm the actual jurisdiction, not just the mailing address. [1035]
